These Terms and Conditions govern your use of our concierge and lifestyle management services, including luxury buying, pre-owned luxury, design & interior, art concierge, gifting, and bespoke services ("Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms and Conditions.

2.1 You may be required to register for an account to access certain features of our Services. You must provide accurate and complete information during the registration process.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Services
3.1 Butler & Co. provides concierge and lifestyle management services, subject to your acceptance and payment as per our pricing and terms.
3.2 We aim to provide the highest quality of service; however, we do not guarantee the availability of specific items or the success of some bespoke requests.
4. Pricing and Payment
4.1 Pricing for our Services is commission based and is subject to change depending on your request. You agree to pay all fees associated with the Services you purchase.
4.2 Additional Charges: Please note that there might be additional charges, such as import taxes and duties, depending on the country of origin and destination of the item. These charges are always the responsibility of the customer.
4.3 Payment processing is handled securely through trusted third-party payment providers. When you make payments for our Services, we collect payment details through secure payment processors as mentioned above or direct bank transfer, as per your preference and our available payment methods.
5. Liability and Disclaimer
5.1 We are not liable for any damages or losses resulting from the use of our Services, including but not limited to the purchase of luxury items, bespoke services, or any actions taken on your behalf.
5.2 Our Liability is Limited to the Extent Permitted by Applicable Lithuanian and European Law:
Our liability is subject to the provisions and limitations set forth by Lithuanian and European law. This means that to the extent permitted by these laws:
- We are not responsible for any direct, indirect, incidental, consequential, or punitive damages that you may incur as a result of using our Services.
- We do not assume liability for any losses, including but not limited to financial losses, emotional distress, or inconvenience, arising from your interactions with our Services.
- We shall not be held responsible for any errors, delays, or interruptions in our Services or any transactions conducted through our Services, except where such errors or delays result from our willful misconduct or gross negligence.
It is important to note that Lithuanian and European law may impose certain obligations and consumer protections that cannot be excluded or limited by these terms and conditions. Therefore, our liability is limited to the extent permitted by applicable law, and any provision in these terms that contradicts or violates such law shall be deemed void.

Service Agreement
This Service Agreement ("Agreement") is entered into between Butler & Co. ("Provider") and the customer ("Customer") effective as of [Effective Date].
1. Services
Provider (Butler & Co.) agrees to provide the Customer with concierge and lifestyle management services as detailed in the corresponding Service Agreement or Purchase Order.
1.2. Payment and Refund Policy
1.2.1 Payment: Customer agrees to pay the fees associated with the services as outlined in the Service Agreement or Purchase Order. Payment can be made through secure payment processors or direct bank transfer.
1.2.2 Non-Refundable Services: Customer acknowledges and agrees that all services provided by Provider (Butler & Co.) are non-refundable unless otherwise specified in this Agreement.
1.2.3 Exceptions to Non-Refundable Policy: Refunds will be issued solely at the discretion of the Provider (Butler & Co.) in the following circumstances:
- If Provider (Butler & Co.) fails to deliver the agreed-upon services as outlined in the Service Agreement due to Provider's (Butler & Co.) fault, negligence, or failure to meet contractual obligations.
1.2.4 Customer Responsibility: It is the Customer's responsibility to review and understand this refund policy before entering into this Agreement. Failure to do so does not exempt the Customer from the terms of this Agreement.
1.3. Liability
1.3.1 Provider's (Butler & Co.) Liability: Provider's (Butler & Co.) liability is limited to the extent permitted by applicable Lithuanian and European law.
Provider (Butler & Co.) acknowledges that its liability is subject to the provisions and limitations established by applicable Lithuanian and European law. This means that the extent of Provider's (Butler & Co.) legal responsibility for any damages, losses, or issues arising from the provision of services is determined by the legal framework governing such matters in Lithuania and the European Union.
Under the legal framework, the following principles apply to Provider's (Butler & Co.) liability:
- Provider (Butler & Co.) is committed to delivering services with a reasonable standard of care and professionalism.
- Provider (Butler & Co.) is responsible for fulfilling its contractual obligations as outlined in the Service Agreement or Purchase Order.
- Provider (Butler & Co.) will not assume liability for damages or losses that result from factors beyond its control or that are not directly related to the quality of the services provided.
- Provider (Butler & Co.) is obliged to comply with all applicable laws and regulations, and any violations may result in legal consequences.
1.3.2 Exceptions: Nothing in this Agreement shall limit or exclude liability for death or personal injury caused by Provider's (Butler & Co.) negligence or for fraudulent misrepresentation.
1.4. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Lithuania.
By entering into this Agreement, the Customer acknowledges that they have read, understood, and accepted the terms and conditions, including the non-refundable nature of the services provided by Provider (Butler & Co.), except in cases where the Provider (Butler & Co.) is at fault.
